THE INFORMATION THAT DAGNE DOVER COLLECTS, AND HOW IT IS COLLECTED:

Dagne Dover collects Personal Information and Anonymous Information from you when you use the Services, create an account, opt-into the Mobile Messaging Service, submit a request or support ticket, or place an order. "Personal Information" means information that can be used to identify a particular individual or Services user, including, for example, your name, address, telephone number, e-mail address, user name, and any information about you that is associated with or linked to any of the foregoing information, such as your IP address or geographic location information. "Anonymous Information" means information that is not associated with or linked to your Personal Information and which cannot be used to identify an individual. Dagne Dover collects and uses Personal Information and Anonymous Information as described in this Privacy Policy.

USER PROVIDED INFORMATION

You may voluntarily provide Personal Information such as your name, email address, postal address, phone number, or credit card information when placing orders or participating in various activities in connection with the Services. Additionally, you may be asked to provide certain Personal Information if you choose to create an account on the Site, including your first and last name, email address, and password. Dagne Dover may also collect your email address if you choose to sign up for email communications or newsletters from Dagne Dover. If you choose to opt-into the Mobile Messaging Service, you will be asked to provide your mobile phone number and we may also collect information about your mobile phone and text messaging service provider.

INFORMATION COLLECTED BY COOKIES

In addition to the information that you choose to voluntarily provide, when you visit the Site, Dagne Dover sends cookies to your computer to collect information from you regarding your web-browsing activities, browser specifications, device specifications, and account settings and preferences.

INFORMATION COLLECTED BY WEB BEACONS

In addition to cookies, Dagne Dover employs "invisible pixels" (a.k.a. web beacons) on the Site and in connection with certain email communications. An invisible pixel is a tiny, 1x1 image that is loaded when you visit a Site, but instead of calling up an image, it causes a cookie or application to be downloaded. Pixels and other web beacons can be used for a number of web tracking or advertising purposes, however, the web beacons implemented on the Dagne Dover Site are limited to the anonymous tracking of Site usage patterns. Additionally, Dagne Dover uses Web Beacons to anonymously track whether certain email communications are opened by recipients.

SERVER LOGS

Dagne Dover’s servers automatically record certain information from your web browser whenever you visit the Site. These server logs include information such as your Internet Protocol ("IP") address, browser type, browser language, referring pages (including URLs), platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, and the date and time of any requests you make while navigating the Site. Dagne Dover uses this information to optimize the Site for your particular browser environment, monitor and analyze Site traffic and Site flow in order to improve Site organization and functionality, and to maintain Site security.
The information collected in the server logs is not personal information and cannot be used to personally identify you. While the server logs are associated with your IP address in order to track specific browsing sessions on the Site, Dagne Dover does not store or associate the information in the server logs—including your IP address—with your account or contact information.

THIRD PARTY USE OF COOKIES AND OTHER TRACKING TECHNOLOGIES

Some content or applications, including advertisements, on the Site are served by third parties, including advertisers, ad networks and servers, content providers, and application providers. HOW DAGNE DOVER USES THE INFORMATION IT COLLECTS:

Dagne Dover uses your Personal Information to process and fulfill any orders you place and to complete any requests you make,including requests to create accounts or receive email communications regarding products and newsletters. As part of processing and fulfilling your orders, Dagne Dover will use your Personal Information to process your payment, as authorized by you during the checkout process, and to communicate with you regarding the status of your order and delivery details. We will also use your Personal Information to provide any of the services you request from us, including in connection with the Mobile Messaging Service.

Dagne Dover also uses the information it collects from you via cookies and other technological means to track and implement your account settings and preferences from session to session, and to remember your password so you do not need to log in every time you visit the Site. Dagne Dover may also use the information it collects to determine your purchase preferences, identify content that may be of specific interest to you, and deliver product offers or other content specific to your interests.

If you receive direct marketing from Dagne Dover, you can opt out at any time by following the instructions included in every email sent to you via the “Unsubscribe” link, or by sending a request to opt out of promotional email communications to privacy@dagnedover.com. Dagne Dover respects your choice and will stop sending you promotional emails once you unsubscribe. Please note, however, that you may not opt out of non-promotional communications from Dagne Dover, including communications confirming successful order placements, communications sent for customer service purposes, notifications regarding important Services or policy changes, communications providing important security or data breach information, and communications containing other significant information related to your Personal Information for as long as it is retained by Dagne Dover.

Consent to receive automated marketing text messages in connection with the Dagne Dover Mobile Messaging Service is not a condition of any purchase. If you have enrolled in the Mobile Messaging Service, you can opt-out at any time by texting the single keyword command STOP to +18335651551 or clicking the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Dagne Dover mobile message programs (to the extent such programs are offered) and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms. You understand and agree that the foregoing options are the only reasonable methods of opting out. You acknowledge that our text message platform may not recognize and respond to unsubscribe requests that alter, change, or modify the STOP keyword command, such as the use of different spellings or the use or addition of other words or phrases to the command, and agree that Dagne Dover and its service providers will have no liability for failing to honor such requests. You also understand and agree that any other method of opting out, including, but not limited to, texting words other than those set forth above or verbally requesting one of Dagne Dover’s employees to remove you from Dagne Dover’s list, is not a reasonable means of opting out.

Dagne Dover may create Anonymous Information records from Personal Information by excluding information (such as your name and/or IP address) that would allow someone to identify a specific individual. Dagne Dover may use this Anonymous Information to analyze request patterns and improve the Site and our performance of services offered through the Site. In addition, Dagne Dover may create and use aggregate or statistical information that is not traceable to any particular individual (such as anonymous user usage data, cookies, IP addresses, browser type, clickstream data, etc.) to improve the quality and design of the Site and to create new features, promotions, functionality, and services by storing, tracking, and analyzing user preferences and trends. We will not perform any automated decision-making processes on the information that we collect.

We may share your Personal Information, including your SMS opt-in or consent status, with third parties that help us provide our messaging services, including but not limited to platform providers, phone companies, and any other vendors who assist us in the delivery of text messages.

Some of Dagne Dover’s third-party partners or contractors may be international organizations or organizations that were formed in the United States. If Dagne Dover shares your Personal Information with such parties, Dagne Dover will use appropriate methods to transmit your information in accordance with all applicable laws and regulations. Such methods may include, but are not limited to, the Privacy Shield framework, model contract clauses, or binding corporate bylaws.

Dagne Dover takes reasonable technical and organizational precautions, in addition to following industry best practices, to protect your information against loss, misuse, alteration, disclosure, unauthorized access, or destruction.

Dagne Dover makes use of Secure Sockets Layer (SSL) technology and keeps sensitive details stored in an encrypted format in the Dagne Dover database. If you provide your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with AES-256 encryption. Although no method of transmission over the Internet or electronic storage is 100% secure, Dagne Dover follows all PCI-DSS requirements and implement additional generally accepted industry standards.

Dagne Dover has implemented other industry-standard electronic means of protecting your Personal Information including storing your Personal Information behind a computer firewall, which is a barrier designed to prevent outsiders from accessing our servers. Except as provided elsewhere in this Privacy Policy, Dagne Dover limits access to your Personal Information, regardless of if it is stored electronically or in physical form, to those persons (including employees and contractors) in Dagne Dover's organization who have a business need for such access.

NOTICE REGARDING SHOPIFY:

Dagne Dover’s online e-commerce platform, which allows you to place orders and pay for purchases, is hosted by Shopify Inc. As such, some of your Personal Information is stored through Shopify’s data storage, databases, and the general Shopify application on a secure server behind a firewall.

If you choose a direct payment gateway to complete your purchase, then Shopify stores your credit card data. It is encrypted through third-party data centers with industry-standard certifications, including the Level 1 Payment Card Industry Data Security Standard (PCI-DSS), Tier III, and ISO 27001. Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that transaction is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express, and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

User Submissions

Content submitted by users of the Web Site for public view is referred to in these Terms of Service as “User Submissions.” For the purposes of these Terms of Service, Product Reviews constitute User Submissions. You shall be solely responsible for your own User Submissions and the consequences of posting or publishing them. You represent and warrant that your User Submissions consist entirely of material and/or information that is owned by you, including, but not limited to, any text, music, recordings, illustrations, photographic images, and videographic clips. • your User Submission (or any portion of it) has not been included in nor planned for use in any other advertising or promotional materials, for Dagne Dover or any third party;

• you are at least eighteen (18) years of age, or at least nineteen (19) if you are from Alabama or Nebraska, or at least twenty-one (21) if you are from Mississippi;

However, by submitting the User Submissions, you hereby grant Dagne Dover an irrevocable, perpetual, worldwide, non-exclusive, royalty-free, sub-licensable (through multiple tiers), and transferable license to use, reproduce, distribute, edit, modify, prepare derivative works of, display, and perform the User Submissions (and any edited or modified versions or derivative works) in any media formats now or hereafter created and through any media channels now or hereafter created. You also hereby grant each user of the Website a non-exclusive license to access your User Submissions through the Website, and to use, reproduce, distribute, prepare derivative works of, display and perform such User Submissions as permitted through the functionality of the Web Site and under these Terms of Service. You also hereby grant to Dagne Dover an unrestricted, worldwide, perpetual, irrevocable, fully paid-up, royalty-free, fully sublicensable right to use your name, nickname, user name, biographical information, vocal recordings of you, and/or any illustrations, photographic or videographic clips, portraits, likenesses or pictures of you or any other indicia of your right of publicity rights (collectively "Your Personal Content") as contained in your User Submission(s), in composite or distorted form or as otherwise incorporated into other creative works of authorship, in any media, format or technology, whether now known or hereafter discovered, and in any manner including, but not limited to, all promotional, advertising, marketing, merchandising, publicity, and commercial uses and ancillary uses thereof, without any further notice or payment to or permission needed from you (except where prohibited by law).

You also agree to waive any applicable moral rights as contained in the User Submissions for any of the proposed uses described above. Without limiting the foregoing, submission of a User Submission constitutes your agreement that Dagne Dover is permitted to display the User Submission online for public viewing and/or comment (whether on Dagne Dover’s Website or on third party web pages), to incorporate the User Submission in online and offline advertising, marketing, promotional, and/or other commercial materials, and to reproduce, adapt, and distribution the User Submission in all media, whether now known or later developed. However, Dagne Dover will have no obligation to post or use any User Submission(s). 

By submitting a User Submission, you agree to release, hold harmless and indemnify on behalf of yourself and your successors, assigns and representatives, Dagne Dover and each of its respective officers, directors, and employees from and against any and all claims, suits, actions, demands, liabilities and damages of any kind whatsoever arising out of or in connection with the use of such User Submission, including, without limitation, any and all claims for copyright infringement, invasion of privacy, violation of the right of publicity or of moral rights, and/or defamation. Dagne Dover reserves the right to remove any User Submissions without prior notice (or to refuse to publish any User Submission) for any reason, and to terminate or refuse a User's access to its Website for any reason.

Dagne Dover is a provider of an interactive computer service for purposes of 47 U.S.C. section 230. As such, its liability for others' conduct and information is limited as described therein. Further, Dagne Dover is a service provider pursuant to the Digital Millennium Copyright Act. Pursuant to the Digital Millennium Copyright Act. Dagne Dover Mobile Messaging Service Terms

The Dagne Dover mobile message service (the "Service") is operated by Dagne Dover. Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”) and our Privacy Policy. By opting in to or participating the Service, you accept and agree to these Mobile Terms, including, without limitation, your agreement to resolve any disputes with us through binding, individual-only arbitration, as detailed in the “Dispute Resolution” section below. These Mobile Terms are limited to the Service and are not intended to modify our Terms of Service, Privacy Policy, or any other agreement that may govern the relationship between you and us in other contexts. In the event of a conflict between the terms of these Mobile Terms and the Terms of Service, these Mobile Terms shall govern with respect to the Service.

We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). You understand that you do not have to sign up for the Service in order to make any purchases, and your consent is not a condition of any purchase with Dagne Dover. Your participation in the Service is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. If you do not wish to continue participating in the Service, you may opt-out at any time. If you have subscribed to other Dagne Dover mobile message programs (to the extent such programs are offered) and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the Service with your new number.

The Service is offered on an "as-is" basis and may not be available in all areas at all times and may not continue to work in the event of product, software, coverage, or other changes made by your wireless carrier. To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service. Delivery of mobile messages is subject to effective transmission from your wireless service provider/network operator and is outside of our control. Dispute Resolution. In the event that there is a dispute, claim, or controversy between you and us, or any other third-party service provider acting on our behalf to transmit the mobile messages within the scope of the Service, arising out of or relating to federal or state statutory claims, common law claims, these Mobile Terms, or the breach, termination, enforcement, interpretation or validity thereof, including the determination of the scope or applicability of these Mobile Terms to arbitrate, such dispute, claim, or controversy will be, to the fullest extent permitted by law, determined by arbitration in New York, NY before one arbitrator.

The parties agree to submit the dispute to binding arbitration in accordance with the Commercial Arbitration Rules of the American Arbitration Association (“AAA”) then in effect. Except as otherwise provided herein, the arbitrator shall apply the substantive laws of the State of New York, without regard to its conflict of laws rules. Within ten (10) calendar days after the arbitration demand is served upon a party, the parties must jointly select an arbitrator with at least five years’ experience in that capacity and who has knowledge of and experience with the subject matter of the dispute. If the parties do not agree on an arbitrator within ten (10) calendar days, a party may petition the AAA to appoint an arbitrator, who must satisfy the same experience requirement. In the event of a dispute, the arbitrator shall decide the enforceability and interpretation of this arbitration agreement in accordance with the Federal Arbitration Act (“FAA”). The parties also agree that the AAA’s rules governing Emergency Measures of Protection shall apply in lieu of seeking emergency injunctive relief from a court. The decision of the arbitrator shall be final and binding, and no party shall have rights of appeal except for those provided in section 10 of the FAA. Each party shall bear its share of the fees paid for the arbitrator and the administration of the arbitration; however, the arbitrator shall have the power to order one party to pay all or any portion of such fees as part of a well-reasoned decision. The parties agree that the arbitrator shall have the authority to award attorneys’ fees only to the extent expressly authorized by statute or contract. The arbitrator shall have no authority to award punitive damages and each party hereby waives any right to seek or recover punitive damages with respect to any dispute resolved by arbitration.

THE PARTIES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY VIA ARBITRATION AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ARBITRATION PROCEEDING.

Further, unless both parties agree otherwise in a signed writing, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding.

Except as may be required by law, neither a party nor the arbitrator may disclose the existence, content, or results of any arbitration without the prior written consent of both parties, unless to protect or pursue a legal right. If any term or provision of this section is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Section or invalidate or render unenforceable such term or provision in any other jurisdiction. If for any reason a dispute proceeds in court rather than in arbitration, the parties hereby waive any right to a jury trial. This arbitration provision shall survive any cancellation or termination of your agreement to participate in the Service.

You warrant and represent to us that you have all necessary rights, power, and authority to agree to these Terms and perform your obligations hereunder, and nothing contained in these Mobile Terms or in the performance of such obligations will place you in breach of any other contract or obligation. The failure of either party to exercise in any respect any right provided for herein will not be deemed a waiver of any further rights hereunder. If any provision of these Mobile Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Mobile Terms will otherwise remain in full force and effect and enforceable. Any new features, changes, updates, or improvements of the Program shall be subject to these Mobile Terms unless explicitly stated otherwise in writing. We reserve the right to change these Mobile Terms from time to time. Any updates to these Mobile Terms shall be communicated to you. You acknowledge your responsibility to review these Mobile Terms from time to time and to be aware of any such changes. By continuing to participate in the Program after any such changes, you accept these Mobile Terms, as modified.

Warranty Disclaimer and Limitation of Liability

You agree that the Web Site shall be deemed a passive service based solely based in New York and shall not give rise to personal jurisdiction over Dagne Dover, either specific or general, in jurisdictions other than New York, except as provided in the Privacy Policy. These Terms of Service shall be governed by the internal laws of the State of New York, without regard to its conflict of laws principles, except as provided in the Privacy Policy. Any claim or dispute between you and Dagne Dover that arises in whole or in part from the Web Site shall be subject to the exclusive jurisdiction of the federal and State courts located in New York, New York. These Terms of Service, together with the Privacy Policy and any other legal notices published by Dagne Dover on the Web Site, constitute the entire agreement between you and Dagne Dover concerning the Web Site. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NO CLAIM UNDER THESE TERMS OF SERVICE SHALL BE JOINED TO ANY OTHER CLAIM, INCLUDING ANY CLAIM INVOLVING ANY OTHER CURRENT OR FORMER USER OF THE WEB SITE, AND NO CLASS ACTION PROCEEDINGS SHALL BE PERMITTED. Most communications between Dagne Dover and you will be sent and received electronically. You agree that all agreements, notices, disclosures, and other electronic communication exchanged between you and Dagne Dover shall satisfy any legal requirements that such communications be in writing.

Return Policy

We accept returns on unused products within 30 days of shipment for orders shipped within the US. However, if something went wrong upon arrival or initial use, please let us know at support@dagnedover.com.

All US returns are subject to a $10 handling fee. If you are returning items from multiple orders, they must be shipped separately. We do not provide shipping labels for international orders. We do not accept returns or exchanges on final sale items.

Any return made on an order with a total value of $1,000 or more will be processed upon receipt and inspection at our return facility, not at the time of shipment or delivery.

When you submit a photograph in connection with Dagne Dover’s customer loyalty program, you retain your rights to your photograph. However, by submitting a photograph, you grant Dagne Dover (and those authorized by Dagne Dover) a royalty-free, worldwide, perpetual , non-exclusive, transferrable, and sublicensable license to publicly display, distribute, reproduce, and create derivative works of the submitted photograph, in whole or in part, in any media now in existence or later developed, for any purpose, including but not limited to, advertising and promotion of Dagne Dover, its website, social media pages, and commercial products. You also agree to irrevocably waive all right of integrity and any other rights to the photograph under Section 106A of the Copyright Act, commonly known as “moral rights,” and, to the extent this waiver is not permitted by applicable law, you agree not to enforce any such moral rights against Dagne Dover or any individual or entity it authorizes to receive copies of the photograph. Any photograph reproduced will include a credit to you and/or your social media username as feasible. Photographs distributed by Dagne Dover on social media may also grant the respective social media platform a license to use the photographs, as described in further detail in each platform’s respective terms of service.

You also grant us the right to use your name, image, likeness, biographical information (if provided), social media username (if provided), and any other information about you that you provide in connection with your submission of a photograph or the creation and maintenance of your customer loyalty account in connection with the photograph and any derivative works created of the photograph for any purpose, including but not limited to, advertising and promotion of Dagne Dover, its website, social media pages, and commercial products.

By submitting a photograph, you represent and warrant that you are at least eighteen (18) years of age and have the full right, power, and authority to enter into this agreement and grant the above license and rights. If the photograph incorporates any person other than yourself, you represent and warrant that you have obtained the permission of each represented person to submit the photograph and to grant the license, rights, and waivers described above on their behalf. You further represent and warrant to Dagne Dover that I will provide only true and correct statements and other information in connection with my submission (including but not limited to the fact that the Dagne Dover products depicted are my own and any opinions expressed about such Dagne Dover products are current, accurate, and truthful and made of your own free will), and that Dagne Dover and its licensee’s use of the photograph and the rights and licenses you grant do not, and will not, violate any intellectual property right (including, without limitation, copyright, trademark, right to privacy, or right of publicity) of, or conflict with or violate any contract with or commitment made to any person or entity and that no consent or authorization from, or any payment to, any third party is required in connection with the submitted photograph. You further agree to defend, indemnify, and hold harmless Dagne Dover and its licensees from and against all claims by third parties resulting from your breach or alleged breach of this agreement or any of these representations and warranties.

Dagne Dover will not be required to pay any additional consideration, royalty, payment, or other compensation or to seek any additional approval from you in connection with the license and rights granted or permitted uses described above.
